2. User Accounts
- You must be at least 18 years old or have parental consent to use our services.
- You are responsible for maintaining the confidentiality of your account and password.
- We reserve the right to suspend or terminate accounts that violate these terms.
3. Subscription & Payment
- Paid subscriptions are billed in advance and are non-refundable, except where required by law.
- We offer a 1:1 learning model, meaning that when you subscribe, a free account is provided to an English learner.
- If you cancel your subscription, the sponsored account will also be canceled.
- Chargebacks or disputed payments may result in immediate suspension or termination of your account.
4. Acceptable Use
- You agree to use our services only for lawful purposes.
- Any misuse, including but not limited to harassment, spamming, or violating copyright laws, will result in account termination.
Fair Use, Rate Limits & Automated Access
- Fair Use. Usage is subject to fair-use limits, which may include hourly, daily, monthly, or annual caps on messages, requests, or tokens.
- Rate Limiting. We may temporarily throttle (slow, defer, or block) requests that exceed fair-use limits. Throttling does not qualify for refunds.
- Automated Access. Bots, scripts, or automated tools that generate excessive traffic are prohibited unless expressly authorized.
- Adaptive Limits. Specific thresholds may change over time based on service costs, capacity, or abuse patterns.
Abuse, Suspension & Blacklisting
- Abuse. We may suspend, terminate, or permanently blacklist accounts for abusive behavior, including excessive automated requests, circumventing limits, harassment, or security testing without permission.
- No Refunds. Suspensions or terminations due to abuse or violations do not entitle you to a refund or credit, except where required by law.
- Notice & Appeal. We may notify you when throttling or suspension occurs, but we reserve the right to act without prior notice. Appeals may be submitted to support@digame.app.
5. AI Character Disclaimer
¡dígame! includes AI-generated conversations that simulate various characters such as language tutors, taxi drivers, life coaches, and others. These characters are fictional and for educational, entertainment, and language learning purposes only.
- The AI is not a licensed professional and does not provide medical, legal, therapeutic, or professional advice.
- Any responses from AI characters are not to be considered facts or guidance for personal or medical decision-making.
- Use of these features is at your own discretion and risk.
- Do not use this service for emergency, crisis, or mental health support.
